A Smithville woman is charged with driving while intoxicated-serious physical injury following an accident that killed her daughter on June 27.
Samantha J. Jones, 31, appeared in Platte County court on June 26 and entered a not guilty plea.
Her daughter, Macklyn Lucas, 5, died from injuries sustained in the June 24 accident.
Her bond was modified from $50,000 cash only to 10 percent cash option. She had various conditions of her bond.
She posted $5,000 bond and is set to return to court on July 10. There haven’t been amended charges yet.
Court documents stated that Jones had a blood alcohol content that was twice the legal limit and that led to an accident near Route E and Skinner Lake Road.
Jones’ Kia Optima hit an electric pole on the north side of the roadway. Platte County deputies responded to the accident with injuries, as a 5-year-old child that was having difficulty breathing.
Jones informed the deputy she had ‘about’ two bottles of wine within the past five hours. She consented to a breath test and her BAC was .198 — the legal limit is .08. A second test at 11:32 p.m., the BAC was .186.
A witness stated Jones said, “I never drink this much. I’m so stupid. My baby is my world. I don’t care if I go to jail, I just want my baby to be OK.”
Jones stated she started drinking at 5 p.m. and left at 8:30 p.m. after having between 1½ to 2 bottles of wine, according to court documents.
